Rules Regarding Releasing Banned Content?

Ok so this is just a question i've been thinking for a while, but lets just think of a metaphorical situation;

If a user decided to put a banned users addon on github, would they be banned for it?

Like if it was for completely non-commercial intent and was just for giving content to the community, Would that still be breaking scriptfodder rules?

Of course the content creator could still DMCA/Report or whatever (i dont know how it works on github) but would you get punnished on scriptfodder for releasing it?
